Statierra Corp. (d/b/a “MixR”) is firmly committed to securing the Personal Information that users (“You” or “You” or “User”) share with MixR in connection with the use of our mobile application (“Application”) and/or by accessing our web platform sites (each a “Website”). The purpose of this Privacy Policy is to provide you notice about the information we may collect, use, share, store and transfer in connection with your usage of the Application and our Websites (collectively, “Services”). This Privacy Policy is incorporated into and is subject to our Terms of Services.

This Privacy Policy is only applicable to our Services. This Privacy Policy does not apply to any websites or applications that are owned or operated by third-parties (“Third-Party Websites/Applications”), which may have data collection, use, share, transfer and storage practices and policies that differ materially from this Privacy Policy and our Terms of Services.

Because of the changing nature of privacy laws, user needs, and our business, we may modify this Privacy Policy from time to time. We encourage you to review our Privacy Policy periodically to become aware of any changes that may have occurred. You can determine when this Privacy Policy was last revised by referring to the date from which it was “Effective” as set forth above. We may also send registered users of the Services e-mail and/or notifications notifying such users of any changes to the Privacy Policy. Your continued use of the Services and/or continued provision of Personal Information to us will be subject to the terms of the then-current Privacy Policy.

By accessing or using our Services, you expressly consent to the terms of this Privacy Policy, and to the collection, use and disclosure of your information, including Personal Information (as specified below), in accordance with the terms of the Privacy Policy. If you disagree with any term provided herein, you may not use the Services.

Types of information we collect and receive

We collect certain information which is personally identifiable information, namely information that identifies an individual or may with reasonable effort identify an individual, or may be of a private nature (“Personal Information”).

The personal information we collect includes the following:

  • When you decide to register with our Services, or when you decide to access or use our Services, you will be requested to provide your first name and last name, email address, password, gender and date of birth. To complete registration, we may contact you in order to authenticate your identity.
  • You may also voluntarily elect to provide information related to your user profile on our Services, including, but not limited to, your photo, education level, personal interests, country and city of birth, phone number, current occupation, work location, languages spoken, any social network identifiers (e.g. Instagram or LinkedIn), marital status, and number of children if any.
  • If you provide us your social network (e.g. Instagram, LinkedIn), we may access such information in your social network profile in accordance with the security restrictions and applicable permissions of the social network that you have set. The third party social network may set a cookie when your browser creates a connection to the servers of such social networks. Your use of these social networks is subject to the privacy policies of the third party social networks.
  • If you do not accept to be localized, we will use an approximate location based on your IP address. If you do accept to be localized, we will use your browser or smartphone location.
  • Internet protocol (IP) address.
  • Any user content you provide through the Application or Website, including, without limitation, any texts, comments, photos, videos, feedback and other content you submit to MixR regarding the groups and/or mixrs that you create or join.
  • Any communications between you and other MixR members.
  • Any communications between you and MixR, including any correspondence that is related to administrative matters or technical matters (for instance, any emails you send us with any technical questions.)

Non-personal information that we collect:

We collect certain information pertaining to users of our Services, which may be made available or gathered via the user’s use of the Services (“Non-personal Information”). Non-personal Information that is collected consists of technical information transmitted by your device and aggregated usage information, and contains certain software and hardware information about your device, including the type of browser your device uses.

Analytics information: We may track how often you use the Services and we may use third-party analytics tools to help us measure traffic and usage trends for the Services. These tools collect information sent by your device or our Services that assists us in improving the Services. We collect, aggregate, use and disclose this analytics information with analytics information from our other users so that it cannot reasonably be used to identify any particular individual.

Cookies and similar technologies: When you use our Services, we may use cookies to collect information about how you use MixR and provide features to you.

Analyzes

The services contained in this part allow the Owner to monitor and analyze web traffic and to monitor the behavior of the User.

Google Analytics (Google Inc.)

Google Analytics is a web analytics service provided by Google Inc. (“Google”). Google uses the Data collected to track and analyze the use of this Application, to prepare reports on its activities and to share them with other Google services. Google may use the Data collected to contextualize and personalize the advertising of its own advertising network.

Internal Analysis System (this Application)

This Application uses an internal analysis system that does not involve any third party.

IP Anonymization in Google Analytics (Google Inc.)

Google Analytics is a web analytics service provided by Google Inc. (“Google”). Google uses the Data collected to track and analyze the use of this Application, to prepare reports on its activities and to share them with other Google services. Google may use the Data collected to contextualize and personalize the advertising of its own advertising network. This integration of Google Analytics makes your IP address anonymous. The IP addresses of the Users are in fact abbreviated within the Member States of the European Union or other States parties to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to the Google server and abbreviated to the United States.

Cookies and tracking

When you use our Services, we may assign your device with a log file or a cookie (session or persistent). A “cookie” is a small piece of information that a website assigns to your computer’s hard drive while you are viewing a web site. Cookies are very helpful and can be used for various different purposes. These purposes include allowing you to navigate between pages efficiently, keep you logged in to the Services, remembering your preferences such as your browser language and making the interaction between you and the Services quicker and easier. You may remove our cookies by following the instructions of your browser preferences; however, if you choose to disable cookies, some features of our Services may not operate properly and your online experience may be limited. MixR currently does not respond to “Do Not Track” signals.

You can change your cookie settings at any time from your settings.

Registration and authentication

The registration or authentication of the User authorizes this Application to identify him and gives him access to dedicated services. As described below, third parties may provide registration and authentication services. In this case, this Application may access Data stored by these third parties for registration or identification purposes. We use information from these services, including your email address, your friends or your contact list.

Google OAuth (Google Inc.)

Google OAuth is a registration and authentication service provided by Google Inc. that is connected to the Google Network.

How do we use the information we collect?

We use your Personal Information and Non-Personal Information:

  • To respond to your inquiries, support request, feedbacks or questions, and update you with information pertaining to your request;
  • To communicate with you (via email, mobile device, etc.) about services that may interest you or with information about your use of the Services, and to authenticate your identity;
  • To resolve disputes and enforce our policies, including investigation of potential violations thereof, or in accordance with any applicable law or regulation, or for the purpose of law enforcement;
  • To provide you with the most relevant additional services and offers;
  • To detect, prevent, or otherwise address fraud, security or technical issues;
  • To improve and maintain our Services.

Sharing your information

We will not rent, sell or transfer your information to third parties outside MixR without your consent or as otherwise described in this Privacy Policy. Should this practice change, we will seek your consent before disclosing information for a third party’s direct marketing.

We may share your Personal Information, as well as Non-PersonalInformation from tools like cookies, log files, and device identifiers and location data, with third-party organizations that help us provide the Services to you (“Service Providers”). Our Service Providers will be given access to your information as is reasonably necessary to provide the Services.

We may share Non-Personal Information, aggregated information or Personal Information in non-human readable form (de-identified) with third parties (including ad networks, advertising companies and service providers) in any of the above circumstances, as well as for the purpose of developing or delivering tailored or targeted advertising (whether via our Services, or websites or applications of third parties).

We may access, preserve and share your information in response to a legal request (like a search warrant, court order or subpoena) if we have a good faith belief that the law requires us to do so. This may include responding to legal requests from jurisdictions outside of the United States where we have a good faith belief that the response is required by law in that jurisdiction, affects users in that jurisdiction, and is consistent with internationally recognized standards. We may also access, preserve and share information when we have a good faith belief it is necessary to: detect, prevent and address fraud and other illegal activity; to protect ourselves, you and others, including as part of investigations; and to prevent death or imminent bodily harm. Information we receive about you may be accessed, processed and retained for an extended period of time when it is the subject of a legal request or obligation, governmental investigation, or investigations concerning possible violations of our terms or policies, or otherwise to prevent harm. We may share Information, including Personal Information, with our parent company, any subsidiaries, joint ventures, or other companies under a common control (collectively “affiliated companies”). We may share and disclose Information, including Personal Information, in the event of a corporate transaction (e.g. sale of a substantial part of our business, merger, consolidation or asset sale).

Any content that you post on the Services will be visible to other members using the Services in accordance with the privacy settings you have selected. Your name is public but you have the option to set certain other data and content to private groups. For private groups, other members that are not within the group can see that the group exists but cannot see the member list or discussions in the group.

Our policy only addresses the use and disclosure of information we collect from you. This policy does not apply to the extent that you disclose your information to other parties via our Services (whether through our Website or Application), via other sites throughout the internet, in your online communications with other members or in person at a mixr, different rules may apply to their use or disclosure of the information you disclose to them.

How we store your information

Your information collected through the Services may be stored and processed in the United States or any other country in which MixR or its Service Providers maintain facilities. MixR or its Service Providers may transfer information that we collect about you, including Personal Information across borders and from your country or jurisdiction to other countries or jurisdictions around the world. If you are located in the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that we may transfer information, including Personal Information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction. You understand that through your continued use of the Services, you may be transferring your information to the United States and if so, you consent to that transfer. Additionally, you understand that any information you provide to us may be processed in countries (including the United States) where laws regarding processing Personal Information may be less stringent than in your country. By registering for and using the Application, you consent to the transfer of information to the U.S. or to any other country in which MixR or its Service Providers maintain facilities and the use and disclosure of information about you as described in this Privacy Policy.

Security or your information

We use reasonable security standards to protect against the unauthorized access to, retention of, and disclosure of data, such as encryption, secure socket layer, firewalls, password protection and other internal restrictions on who can access data. Please keep in mind, however, that despite these reasonable efforts to protect data on our servers, no method of transmission over the Internet is guaranteed to be secure. Therefore, while we strive to protect your data, we cannot guarantee its absolute security and shall not be liable for any breach of security by an outside party. You are responsible for maintaining the secrecy of your password and account information. We are not responsible for the functionality, privacy, or security measures of any third parties.

We also use industry-leading encryption products to protect customer data during transmission between a customer's network and the MixR services and at rest.

Data at rest
MixR employs a wide range of encryption capabilities up to AES-256.
Data in transit
MixR uses and enables the use of industry-standard encrypted transport protocols, such as Transport Layer Security (TLS) and Internet Protocol Security (IPsec).
Encryption keys
All encryption keys are properly secured.

As an exception, we do not encrypt the profile photos of members and the covers of groups and mixrs. If an organization needs to encrypt profile photos, this can be offered as an option.

For how long do we retain the information we collect?

You may, at any time, change, update or remove your Personal Information. To remove or change your profile information you must change it by accessing your user settings. Please note that we retain the information we collect (including your Personal Information) for as long as needed to provide the Services and to comply with our legal obligations, resolve disputes and enforce our agreements, which may extend to times after which you have terminated your MixR account.

To request and obtain removal of, content or information posted or displayed on our Services, you may remove the content by accessing your account or you may contact MixR at privacy@mixr.net. Please note that if your account is terminated or suspended, any content that you posted on our Services will remain visible according to your privacy settings and the Services will indicate the posting is from a former member or an anonymous member. If your content is removed from the Services, this does not ensure complete or comprehensive removal of the content (for example, the content may have been copied by others before removal or we may retain the content on our servers).

Children’s information

Our Services are not intended for or targeted to minors under the age of 16, and we do not knowingly collect Personal Information from children. If we become aware that a user is under the age of 16, we will remove their information from our files. We reserve the right to request proof of age at any stage so that we can verify that children are not using the Services. However, we are under no obligation to verify the age of any user. If you believe your child has provided us with Personal Information and/or is using our Services, and you would like to have their information removed from our servers, please contact us at privacy@mixr.net

Third-party links

The Services may contain links to, or otherwise may allow you to connect to and use certain third-party products, services or software under separate terms and conditions such as a payment provider (collectively, “Other Services”) in conjunction with the Services. If you decide to access and use such Other Services, be advised that the third-party privacy policy governs your use. MixR does not endorse, is not responsible for, and makes no representations as to such Other Services, their content or the manner in which they handle your data. MixR is not liable for any damage or loss caused or alleged to be caused by or in connection with your access or use of any such Other Services, or your reliance on the privacy practices or other policies of such Other Services.

Your choices regarding e-mail communications

We may send periodic promotional or informational emails to you. You may opt out of such communications by following the opt-out instructions contained in the email. Please note that it may take up to 10 business days for us to process opt-out requests. If you opt out of receiving emails about recommendations or other information we think may interest you, we may still send you emails about your account or any services you have requested or received from us.

Delete profile information from MixR

To meet global data privacy laws, including the General Data Protection Regulation (GDPR) and the California Consumer Protection Act (CCPA), the organization manager can delete a member’s profile information. We’ve outlined some key details below for both members and managers, but contact us if you have questions.

Some background

  • Deletion is permanent – once profile information is removed, it can't be recovered.
  • The organization manager controls their workspace’s data (we call this customer data). This includes all of the content submitted by members, along with member profile information.
  • When members leave an organization, they may have the right to request that their profile information be deleted by the organization manager. As the data controller, the organization manager is responsible for determining whether profile information requires deletion.
  • The organization manager can delete a member’s profile information after the account is deactivated. An organization manager can also contact MixR to request deletion assistance.

You can request to delete your profile information directly from MixR.
